How This Addendum Works
This Mobile Application Development Addendum sets the specific terms for projects involving native or cross-platform mobile apps for iOS and Android. It's a part of our main Agreement and works together with our Master Terms of Service (MTS) and your project's Statement of Work (SoW).
This document covers the unique challenges of mobile development. For web-based platforms and applications, our Web Application Development Addendum would apply instead.
The App Store & Google Play Store
Getting your app to users means working with Apple's App Store and the Google Play Store. Here’s how we handle that partnership:
Your Developer Accounts
You are responsible for creating, maintaining, and paying the fees for your own developer accounts (the Apple Developer Program and Google Play Console). This is crucial because it ensures you always have legal ownership and control over your app's distribution.
Our Role in Submission
Our job is to prepare the final application files (the builds) and guide you through the submission process. We'll help you prepare the necessary screenshots, descriptions, and technical information required by the stores.
App Store Approval (The Important Part)
We will build your app to comply with the known guidelines of Apple and Google. However, the final decision to approve or reject an app rests entirely with them. We cannot guarantee approval. If your app is rejected, we will help you understand the feedback and plan the necessary changes. Significant work required to address a rejection may be handled as a Change Request.
Development & Testing
We follow the same agile, collaborative process for mobile apps as we do for web apps, working in Sprints and getting your feedback at every stage.
Device & OS Support
The mobile world is vast. We will build and test your app to work on the latest major versions of iOS and Android. The specific devices and OS versions we officially support will be listed in your SoW. While the app will likely work on a wide range of devices, we cannot test for every single one unless explicitly included in the project scope.
Testing Builds
We will provide you with test versions of the app throughout the development process using platforms like Apple's TestFlight and Google Play's internal testing tracks.
Technology & Intellectual Property
The same principles from our other agreements apply here:
Your App is Yours
Upon final payment, the custom code we wrote specifically for your mobile app ("Foreground IP") becomes your property.
Our Right to Showcase
We retain the right to feature the completed app in our portfolio and marketing materials, always respecting any confidentiality needs.
Our Reusable Tools
We may use our own pre-existing code and tools ("Background IP") to build your app efficiently. These tools remain our property, and you get a license to use them as part of your project.
Third-Party Services
Modern mobile apps often rely on external services for features like:
- Push Notifications (e.g., Firebase Cloud Messaging)
- Analytics (e.g., Google Analytics for Mobile)
- Backend Servers & APIs
You will be responsible for setting up any necessary accounts for these third-party services. We will handle the technical integration, but the terms and costs of those services are between you and the provider.
What's Not Included (The Exclusions)
This addendum covers the development of the mobile app itself. The following are not included unless specified in your SoW:
- App Store Optimization (ASO): Marketing your app within the app stores.
- User Acquisition & Marketing Campaigns.
- Ongoing Maintenance & Updates: Supporting new OS versions or devices after the project launch is covered by a separate Hosting & Maintenance Addendum.
